Types of Family Court Records for Stillwater

The Payne County District Court handles all family law matters for Stillwater residents. Divorce (dissolution of marriage) is the most common type of family case. The file includes the petition, summons, response, financial disclosures, and the final decree. Under Title 43 of the Oklahoma Statutes, both fault and no-fault grounds exist for divorce. Oklahoma also imposes a six-month ban on remarriage after a divorce, except to the former spouse.

Stillwater Family Court Records Retention

Under Title 20 O.S. § 1005, family court records involving minor children must be kept for 20 years. Cases without children get 10 years. Protective orders are retained for 10 years after the order is issued. The Payne County Court Clerk follows these statewide rules. Before records can be destroyed, they must be stored on at least two separate media. Under the Oklahoma Open Records Act (Title 51 O.S. § 24A.1), most family court records are public and open to inspection during regular business hours.
